GENERAL
1) Thermohome Limited shall mean “the company” the persons whose names and address is written overleaf and the person who has signed this order shall mean “the customer”. “The site” shall mean the place where the work is being done.
ACCESS
2) In the placing of this order the customer agrees to provide to the company unrestricted access to all areas of the house including the Loft area and meter cupboards or all other areas that are needed by Thermohome Limited staff.
a. “The customer” shall grant access to all external areas and external roofs including flat roofs, notwithstanding the provision of scaffolding.
b. “The customer” must protect the company whilst on site from guard dogs, exotic pets, restrictive alarm systems, electronically operated gates or all other conditions that would endanger or infringe with the normal working process of Thermohome Limited staff.
c. During the works period, “the company” will take every precaution whilst on site, however, areas of flowerbeds, planted beds, planted areas, shrubs or hedges shall be the responsibility of the customer, and therefore no responsibility will be accepted by the company for any damage caused to them during the work.
SURVEY
3) The company is responsible for carrying out all on site measurements to satisfy itself that the property is suitable, the company must notify the customer in writing if the property is unsuitable.
INSTALLATION
4) The installation is for Renewable Energy and alternative products.
DELAYS
5) The company agrees to make every effort to complete the works within the estimated time indicated overleaf. However, no penalties will be imposed whatsoever by the customer for delays beyond the reasonable control of the company.
PAYMENT
6) Deposit Payments shall be made by credit card, cheque or Bank Transfer. The provisions of this order do not allow payment by cash unless it is the final balance, which will be paid to the installation team.
a. All payments shall be made in strict accordance with the payment terms on the day of installation. Goods will remain the property of the company until paid for in full.
ADDITIONAL WORKS
7) Any additional works agreed between the customer and the company must be clearly written on the front of this order under the section “Other products” detailing the work to be carried out, and if it is included in the price agreed shall be covered by these terms and conditions.
WARRANTY
8) All products offered by the company are sold under the Sale of Goods Act 1979 and the Supply of Goods and Service Act 1982. 9a) The products supplied and installed by the company are covered by a Consumer Protection Association
(CPA) insurance backed guarantee scheme.
a. All components of the PV system and heat pumps are covered by the manufacturer’s warranty (See leaflet for full details).
VARIATIONS
9) Any variations to the order must be notified to the company in writing within three days of the date of this order, however, once the survey is completed variation cannot be accepted.
CANCELLATION
10) Should you wish to cancel, you have fourteen working days to notify us in writing at the following address: Unit 30, De Havilland Road, Skypark, Clyst Honiton, Exeter, Devon EX5 2GE. You can also contact us via our website or email us. If you have knowingly waived right for reasons which are agreed by both parties, you must sign a separate variation of order (VOD) to support this order.
11) Refunds will be processed within 14 days of cancellation and will be issued in the form of a cheque.
CONCILIATION AND ARBITRATION
12) All members of the CPA have a minimum of a 2 year workmanship guarantee.
13) This guarantee will be made available by the CPA to any customer or prospective customer who wished to inspect the guarantee prior to placing their order.
14) Your Guarantee will be issued and come into force once payment of all outstanding balances have been received and cleared. Nothing in the guarantee restricts or affects any statutory rights. It will cover all the main components of the installation including the quality of workmanship.
15) RECC Code of Practice is approved by Chartered Trading Standards Institute.
a. Fully vetted and Accredited Installers (to provide reassurance).
b. Free Deposit Protection (up to 25% of the contract value).
c. Free Insurance Backed Guarantee (for every customer from CPA)
d. Free Mediation (to help fully resolve any disputes should arise).
e. Access to Ombudsman (to conclude disputes without incurring legal fees or costs).
f. All members installing FITS generated products will be MCS registered.
